The Compilation of Islamic Law (Kompilasi Hukum Islam [KHI]) is a landmark in the codification of Islamic family law in Indonesia, yet it is often viewed primarily as a product of state policy rather than the result of juristic thought. This study examines how Ahmad Azhar Basyir’s methodology of ijtihad was transformed into positive legal norms during the formulation of the KHI. Using normative legal research combined with intellectual history and content analysis, the study analyzes Ahmad Azhar Basyir’s works on marriage, inheritance, and waqf, alongside KHI drafting documents, legislation, and scholarly literature on Islamic legal reform. The findings reveal that his contribution extended beyond legal doctrine by shaping the methodological foundation of the KHI through maqāṣid al-sharīʿah, maṣlaḥah, cross-madhhab ijtihad, and a strengthened role of the state in ensuring legal certainty. These influences are reflected in provisions on marriage registration, judicial divorce, joint marital property, wasiat wajibah, and the development of productive waqf. The study proposes the conceptual model From Juristic Thought to Legal Codification, demonstrating that Islamic legal codification evolves through juristic reconstruction, institutional negotiation, and legal codification. This model contributes to Islamic Family Law scholarship by explaining codification as a dynamic interaction between juristic reasoning, social needs, and state legal institutions.
