Aspek Hukum Fikih dari Hadis tentang Perwalian dalam Pernikahan

This article discusses the legal aspects of fiqh in the context of the Hadis regarding guardianship in marriage, with a focus on analyzing the validity of the sanad, legal istinbath and its objectives. The Hadis regarding guardianship emphasizes the importance of the presence of a guardian in the marriage process, which functions to protect women's rights and ensure the validity of the husband-wife bond. On the other hand, guardianship in fiqh provides a clear legal framework regarding the rights and obligations of both parties. This research analyzes Hadis sources related to guardianship and explains various opinions of scholars regarding the terms and forms of guardianship in marriage. With an analytical approach, this article also examines the problems faced in the application of these legal aspects and is also reviewed from the maqasid of Sharia. The research results show that a deeper understanding of Hadis and fiqh can help create harmony between truth values and the needs of today's society.
