Marriage registries which previously did not recognize the separation of property now  have developed in such a way and provides opportunities for the parties to create a marriage contract for the common good. The existence of Article 29 paragraph 4 of Law Number 1 of 1974 which legalizes marriage contracts and discusses about an implementation of legal protection of marital property by creating a deed of a marriage contract and obstacles to its implementation needs to be studied and acknowledged further. Thus, the function of the research is to find out how the practice of legal protection of marital property by making a marriage contract deed works and discuss the obstacles that may occur in the process. Normative juridical method is used for this research. Data collection is done by reading, examining and gathering information from primary secondary book materials sourced from literature or literature reviews. The results of this study obtained from descriptive data analysis used in describing the nature of the problems studied. The results of the study show that legal protection of marital property with a marriage contract before a marriage taking place in Indonesia has been widely practiced on the basis that most of it is included in the Civil Code and the Compilation of Islamic Law (KHI). The legal consequences of the marriage contracts equate to the agreement, therefore the marriage contracts created and acknowledged are applied as law for the clients.  If one party does not perform obligations contained in the marriage contract, the other party to a marriage may seek an annulment or ask for alimony. Obstacles to the practice include distribution of property and bad faith from one of the parties in the implementation of the contracts. ER -
