Reinterpretasi Konsep Al-Qatl Yamna Al-Irth Sebagai Penghalang Waris Dalam Kompilasi Hukum Islam

This study examines the application of the principle of Al-Qatl Yamna' al-Irth as stipulated in Article 173 of the Compilation of Islamic Law (KHI). Issues arise because the provision is restrictive and fails to account for a situation where an heir kills a co-heir with the aim of increasing their share of the inheritance. Employing normative legal research, the study adopts statutory, conceptual, and case approaches. The findings reveal that the murder of a fellow heir constitutes an act of inheritance manipulation and shares the same legal 'illah (effective legal cause) as the murder of a testator, thereby warranting its classification as an impediment to inheritance. Accordingly, a reinterpretation of Article 173 of the KHI through legal reconstruction based on the principle of Sadd al-Dzari’ah is necessary to ensure greater legal certainty.
